Is the contract void if the seller doesn't sign it?
I booked my wedding photographer 2 months ago. I signed the contract first and sent it back for him to sign, along with the deposit. Since then I've called and emailed him repeatedly, leaving messages asking when he was going to send a copy of the contract with his signature back to me. I haven't been able to reach him, but he has cashed the check I sent him. At this point, I'm ready to find another photographer and I want to know what my legal options are. Is the contract void if it was signed by me and not the photographer?
And- How should I go about getting my money back if I can't reach him?
His accepting of the deposit makes the contract binding. But forcing him to perform the services contracted for is another matter. If you can't contact him, you'll probably have to go to small claims court to get your money back (Assuming it is withing the small claims limits). If you want you can also file a breach of contract suit to make him pay for any added expenses you incurred getting another photographer.
