Please tell me the difference between goods identified to the contract and goods contracted for. ?
I am studying contracts in BarBri book for MBE(Multistate Bar Exam).
But, I can't understand the meaning of the following paragraph.
Please tell me the meaning of the following paragraph or the difference between goods identified to the contract and goods contracted for.
Buyer can recover the goods contracted for if the buyer is unable to cover and the goods were either in existence when the contract was made or were later identified to the contract.
Buyer can recover the goods contracted for if the buyer is unable to cover and the goods were either in existence when the contract was made or were later identified to the contract.
Means the buyer can get the goods, that he paid to have made in the contract, if they existed when the contract was made; or were later created AND labeled as part of the goods meant to the fulfillment of the contract.
Another words if the contract falls into default they the buyer can recover the goods that were meant to fulfill the contract that existed prior to the contract and those that were made after the creation of the contract provided that they were identified as goods made to fulfill the contract.
